UK Workshop - Terms and Conditions

This agreement is made between the participant (hereafter referred to as "the Participant") and Wild Ethos Photography Tours Ltd (Company Number: 17092334), trading as Marc Humphrey Photography (hereafter referred to as "the Company"). It is agreed that the terms set out below constitute the entire agreement between the parties and that no variation or modification shall be effective unless agreed by both parties in writing.

1. Booking and Payment


1.1
Every photography workshop must be paid for in full at the time of booking to secure the Participant's place.

1.2 Following a successful booking, the Participant will receive an email confirmation along with an invoice.

1.3 Payment of the workshop fee constitutes full acceptance of these Terms and Conditions by the Participant.

2. Cancellations and Refunds


2.1
If the Participant requests to cancel the workshop at least 28 days before the workshop date, the Participant is entitled to a 50% refund.

2.2 If the workshop is cancelled by the Participant within 28 days of the workshop date, no refund will be given.

2.3 All cancellations must be made in writing by the Participant via email to photography@marchumphrey.com.

3. Amendments and Company Cancellations


3.1
The Company reserves the right to make amendments to the workshop itinerary. Where amendments materially affect the Participant, the Participant will be offered the option to accept the changes, transfer to an alternative workshop, or request a full refund.

3.2 In the event that a workshop must be cancelled by the Company due to adverse weather or unforeseen circumstances, the Participant will be offered the opportunity to rebook, transfer to an alternative workshop of equal value, or receive a full refund if a mutually convenient date cannot be agreed.

4. Wildlife and Environment


4.1
The Participant acknowledges that wildlife photography workshops involve working with completely wild, unbaited animals in their natural environment and that sightings or specific animal behaviours can never be 100% guaranteed. Field flexibility is required, and no refunds or compensations will be issued based on wildlife activity.

5. Liability Limitations & Insurance Cover


5.1
The Company accepts no responsibility for loss or damage to personal belongings, transport vehicles, nor for any additional travel or accommodation expenses incurred by the Participant. As workshops take place in challenging outdoor environments, Participants are strongly advised to ensure their photographic equipment is fully insured against accidental damage or loss.

5.2 Nothing in these terms excludes or limits the Company’s liability for death or personal injury caused by the Company's direct negligence. Subject to this, the Company accepts no liability for injury, loss, illness, or harm suffered by the Participant during the workshop.

6. Proprietary Rights and Intellectual Property


6.1
The Participant agrees to keep specific workshop locations confidential and not disclose them publicly, including on social media geotags or public forums.

6.2 The Participant agrees not to return to specific workshop locations for the purpose of commercially running, marketing, or promoting their own independent workshops or tours.

7. Behaviour and Ethics


7.1
The welfare of our wildlife subjects always comes first. The Company reserves the right to terminate a workshop session immediately if Participant behaviour negatively impacts wildlife, causes unnecessary stress to animals, or breaches safety guidelines. In such cases, no refund or compensation will be offered.

8. Complimentary Print Fulfilment


8.1
The complimentary 8" x 12" print included with the workshop must be claimed by the Participant within thirty (30) days of the workshop follow-up email being received. Failure to submit the file within this timeframe will result in the automatic forfeiture of the print. The Company is not responsible for the print quality if the Participant submits a low-resolution file.

9. Physical Fitness and Site Suitability


9.1
The Participant acknowledges that the physical activity levels vary per workshop and are clearly detailed on the respective webpage at marchumphrey.com. It is the sole responsibility of the Participant to ensure their physical fitness aligns with the specified terrain, including but not limited to boggy ground, steep riverbanks, or extended walking distances. The Company reserves the right to curtail a Participant's session or remove them from the field without a refund if their physical fitness prevents safe completion of the itinerary or compromises group safety.
